Passenger Agreement, Release & Code of Conduct

This is a binding legal agreement between Hitch-A-Ride LLC ("Hitch-A-Ride," "we," "us") and the person booking (the "Purchaser") and everyone who rides (each a "Passenger"). By checking the agreement box and completing your booking, or by boarding, you agree to all of these terms. Please read them carefully.

1What we are & what this covers

Hitch-A-Ride is a trip organizer that arranges charter bus transportation to sporting events. We do not own, operate, or maintain the buses and do not employ the drivers — transportation is provided by an independent, licensed motor carrier (the "Carrier"). We are not a common carrier. Our service is limited to transporting Passengers from the designated Tuscaloosa pickup point to the vicinity of the event and back. We are not responsible for anything that happens off the bus, including at rest stops, tailgates, the stadium, or while you are away from the bus. In this Agreement, "Released Parties" means Hitch-A-Ride LLC and its owners, members, employees, and agents.

2Eligibility, age & your party

You must be 18 or older to purchase or to ride unaccompanied. A Passenger under 18 may ride only if a parent or legal guardian is riding on the same booking and completes the Minor Addendum (§23). The Purchaser confirms they are authorized to accept this Agreement on behalf of every Passenger in their party, will share these terms with them, and that each Passenger is bound by it. Each Passenger also agrees by boarding.

3Bookings, fares & tickets

Fares are shown at booking; one seat is one Passenger. Payment is processed by Stripe; you authorize us to charge your payment method for the fare and any amounts you owe under §9. Tickets are non-transferable and valid only for the named Passengers; each name must match a photo ID (§10). Name changes are allowed under the Refund Policy (§14).

4Assumption of risk

Bus travel involves inherent risks, and you knowingly and voluntarily assume all of them, including: collisions and accidents; sudden stops, starts, or maneuvers; road, traffic, and weather conditions; boarding and exiting; slips, trips, and falls; the acts or omissions of other Passengers, the Carrier, the driver, or third parties; exposure to illness; delays; and missed connections or events — whether or not specifically listed.

5Release & waiver of liability

To the fullest extent permitted by law, you (for yourself, your party, and your heirs, estate, and successors) release the Released Parties from all claims for injury, death, loss, or damage arising out of or relating to the Trip, including claims based on ordinary negligence, and agree not to sue on any released claim. This release does not apply to gross negligence, recklessness, or willful or wanton misconduct, or to any liability that cannot be released under law.

6Indemnification

You agree to indemnify and hold the Released Parties harmless from any claim, loss, liability, damage, fine, or expense (including reasonable attorneys' fees) arising from your acts or omissions, your violation of this Agreement, or any injury or damage you cause.

7Passenger Conduct Rules

As a condition of riding, you agree to:

Enforcement. The driver and staff may, in their sole discretion, refuse boarding to or remove anyone who violates these rules, appears impaired, or poses a risk — at any point, including away from home, with no refund — and may involve law enforcement and bar violators from future trips.

8Alcohol, drugs & weapons — zero tolerance

The bus is strictly alcohol-, drug-, and weapon-free. You may not possess or consume alcohol or illegal drugs on the bus and may not board while intoxicated. You assume all risk arising from your own consumption of alcohol or other substances, and the Released Parties are not liable for it. Violations may result in immediate removal without refund and referral to law enforcement.

9Damage & cleaning

You are responsible for the cost of any damage or excessive cleaning you cause, including any cleaning fee, repair cost, or out-of-service charge the Carrier assesses — for example, a minimum cleaning fee of $250 for bodily fluids or excessive mess, plus actual repair costs. If the responsible person in a party cannot be identified, the Purchaser is responsible for damage caused by their party. You authorize us to charge these amounts to your payment method.

10Boarding, ID & timeliness

Every Passenger must present a valid photo ID whose name matches the reservation; without it, boarding may be denied with no refund. Buses depart promptly and will not wait for late Passengers. If you miss any departure (including the return), you forfeit your fare and are responsible for your own transportation. We do not guarantee arrival by any particular time and are not responsible for missed events due to traffic, weather, or delays. Seating is first come, first served.

11Health, medical & accessibility

You represent that you are fit to travel. There is no medical professional on board. In an emergency you consent to us arranging emergency care at your expense, and we are not responsible for its cost or outcome. Disclose any condition needing accommodation in advance. The bus is not wheelchair accessible; accessibility or service-animal needs must be requested in advance (hitcharideservice@gmail.com). We cannot guarantee an allergen-free environment and may refuse travel to anyone who appears to pose a health or safety risk.

12Personal property

You are responsible for your belongings. The Released Parties are not liable for property that is lost, stolen, damaged, or left behind on the bus or at any pickup or drop-off point.

13Changes, delays, cancellations & force majeure

Event times and dates may change (including on short notice); we may adjust departure times and will make reasonable efforts to notify you. We may cancel, reschedule, or modify a Trip due to circumstances beyond our reasonable control — including weather, road conditions, mechanical issues, Carrier availability, insufficient enrollment, event changes, public-health orders, or government action ("Force Majeure"). If we cancel, your sole remedy is a refund of the fare paid or a credit, at our option; we are not responsible for other costs (event tickets, lodging, or other expenses).

14Refund & cancellation policy

Refund requests: hitcharideservice@gmail.com. Because services are provided as agreed, you agree not to initiate a chargeback for a Trip you booked; disputes are handled under this policy.

15Communications consent

You consent to receive Trip-related communications (email, and if you provide a mobile number, text messages) about your booking, departures, and changes. Message/data rates may apply; you can opt out of non-essential messages at any time.

16Photo & media release

You grant us permission to use photos or video taken during the Trip for promotional purposes without compensation. Accepting this release is required to book.

17Privacy

We collect the information you provide (names, contact details, passenger roster) to operate the Trip and process payments through Stripe (we do not store your full card number). We use this information only to run the service and communicate with you, and do not sell your personal information. Questions: hitcharideservice@gmail.com.

18Limitation of liability

To the fullest extent permitted by law, the Released Parties' total liability arising out of or relating to your booking or Trip will not exceed the amount you paid for that booking, and the Released Parties will not be liable for indirect, incidental, or consequential damages. Nothing here limits liability that cannot be limited under law.

19Disclaimer of warranties

The Trip is provided "as is." We disclaim all warranties to the extent permitted by law and do not guarantee arrival by any particular time or any particular experience.

20Choice of law & forum

Choice of law. This Agreement, and any dispute arising out of or relating to it or the Trip (whether in contract, tort, or otherwise), is governed by the laws of the State of Alabama, without regard to its conflict-of-laws principles and without regard to the state(s) through or to which the Trip travels. Forum. Any such dispute will be brought exclusively in the state or federal courts located in Tuscaloosa County, Alabama, and you consent to the jurisdiction and venue of those courts.

21Severability

If any provision is held invalid, illegal, or unenforceable, it will be enforced to the maximum extent permitted, or modified to the minimum extent necessary, or if it cannot be, severed — and the remaining provisions continue in full force. In particular, if the Release (§5) or Limitation of Liability (§18) is held unenforceable as to any claim or party, it still applies to the fullest extent the law allows to every other claim and party.

22General

This is the entire agreement on its subject and may not be modified except in writing by us. Our failure to enforce a provision is not a waiver. We may assign this Agreement; you may not. Provisions that by their nature should survive (including §§4–6, 9, 18, 20, 21) survive completion of the Trip. Your electronic acceptance is valid and enforceable as your signature under the E-SIGN Act and applicable law.

23Minor Addendum (under-18 riders)

If any Passenger is under 18, the parent or legal guardian who is riding on the Trip agrees to this Agreement on the minor's behalf and their own; accepts the assumption of risk, release (§5), indemnification (§6), and Code of Conduct (§7) as to the minor; is responsible for the minor's compliance and any damage they cause; and authorizes emergency medical care for the minor at their expense. This is confirmed by the parent/guardian box at checkout.
